Terms and conditions

This contract (“Contract”) is a distance contract pursuant to art. 50 et seq. of Legislative Decree no. 206 of 6 September 2005 (“Consumer Code”). The Contract concerns the sale of movable goods between Budi Srls, VAT number: 02382370688. Registered office at Via Sicilia, 20 Montesilvano (PE) (“AlidiLuna”) and the consumer (the “Customer”). The Contract is concluded directly through AlidiLuna's acceptance of a purchase proposal made by the Customer online on the website www.alidiluna.it (the “Site”) based on the methods described in Article 3 below.

Prices
The prices of the products shown on the AlidiLuna website include VAT and all other taxes. Shipping costs are the responsibility of the customer.

Purchase and payment methods
The Customer will be allowed to choose one of the following payment methods: (a) Credit Card (b) PayPal (c) Cash on Delivery; or any other payment method indicated from time to time as valid by AlidiLuna through communications on the Site.

Product delivery – complaints
AlidiLuna delivers the products to the address indicated by the Customer within 24/48 hours of receiving payment.

Product Availability
AlidiLuna accepts customer orders within the limits of the quantities of the requested products available in stock. Therefore, AlidiLuna's acceptance of the purchase proposal submitted by the customer is subject to the availability of the products in stock. AlidiLuna undertakes to promptly notify the customer of any unforeseeable stock shortages due to excess demand or other causes.

Guarantees and assistance
For products purchased by the Customer, the regulations regarding guarantees and assistance relating to the sale of consumer goods apply to AlidiLuna.

Customer Obligations
The Customer declares and guarantees: that he or she is a consumer as per Article 3 of the Consumer Code; that he or she is of legal age; and that the information provided by him or her for the execution of the Contract is true and accurate.

Right of withdrawal
The Customer has the right to withdraw from the contract entered into, without any penalty and without specifying the reason, within 10 days of receiving the products.

The Customer may exercise the right of withdrawal, within the aforementioned deadline, by expressing this via written communication, registered letter with acknowledgement of receipt to Budi Srls, VAT number: 02382370688. Registered office in Via, Sicilia, 20 Montesilvano (PE).

Customers wishing to exercise their right of withdrawal must return the products to the address indicated on the invoice, following the instructions therein, within 30 days of receiving the products.

The costs of returning the products are borne by the Customer. AlidiLuna will refund, within 10 days of the date of receipt of the products by the Customer: (I) the full price paid by the Customer in the event of a return of the product complete with all its parts and functions; or (II) the portion of the price equivalent to the product actually returned by the Customer who has worn the product to an appreciable extent and/or significantly reduced its value.

Competent court
The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation, or breach of the Contract shall be subject to the exclusive jurisdiction of the Court of Padua.

Force Majeure
In any case of force majeure or unforeseeable circumstances, AlidiLuna shall not be held liable for any delay or failure to deliver and reserves the right to terminate the contract in whole or in part, suspend or postpone its execution.
